Who are the information requesters and persons affected?
Requesters for information are persons who apply to UWB with a request for information in the sense of Act No. 106/1999 Coll., on free access to information, as amended.
Affected persons are persons who could be affected by the provision of the requested information (e.g. persons affected by the request for information or the information requested).
Whose personal data is processed
UWB processes personal data of requesters of information and affected persons who are natural persons.
Why and on what legal basis does UWB process personal data?
UWB processes personal data of requesters of information and persons affected for the following purposes (for each purpose of processing we also indicate its legal basis):
handling the request for information (including any appeal and other follow-up procedures), notifying the person concerned of the request and enabling them to exercise their rights, communicating with the applicant or the person concerned
• compliance with legal obligations (Article 6(1)(c) GDPR)
publication of information provided upon request via the UWB website
• compliance with legal obligations (Article 6(1)(c) GDPR)
collecting and administering any reimbursement of costs for the provision of information
• compliance with legal obligations (Article 6(1)(c) GDPR)
• the legitimate interests of UWB (Article 6(1)(f) GDPR)
the fulfilment of our other legal obligations under generally binding legal regulations (e.g. the obligation to keep accounting and tax documents)
• compliance with legal obligations (Article 6(1)(c) GDPR)
the protection of the rights, legitimate interests and property of UWB, in particular the establishment, exercise or defence of our legal claims (e.g. proving the proper handling of a request for information)
• legitimate interests of UWB (Article 6(1)(f) GDPR)
The applicant for information is obliged to provide UWB with personal data in the scope required by Act No. 106/1999 Coll., on free access to information, as amended, for the purpose of processing the request for information. Failure to provide such data may prevent the processing of the request for information.
What personal data does UWB process?
UWB only processes personal data that are adequate, relevant and limited to the necessary scope in relation to the purpose for which they are processed.
The personal data that UWB may process about requesters for information can be divided into the following categories:
- identifying information (e.g. name, surname, date of birth, permanent address, residential address, signature);
- contact details (e.g. delivery address, email, data box ID);
- the information contained in the request for information;
- bank details (e.g. bank details in the case of a request for reimbursement of the cost of providing the information);
- other information that will be provided to us in the course of processing the request (e.g. information from mutual communications).
The personal data that UWB may process about the persons affected can be divided into the following categories:
- identification data (e.g. name, surname);
- contact details (e.g. delivery address, e-mail);
- information about the person affected as set out in the request for information;
- other information that will be provided to us in the course of processing the request (e.g. information from mutual communications).
How long does UWB keep personal data?
UWB will process personal data only for the time necessary for the purpose of processing. If personal data are used simultaneously for several different processing purposes, UWB will process them until the purpose with the longer processing period is no longer applicable. However, UWB will stop using them for the purpose with a shorter processing period once this period has expired.
UWB uses the following criteria to determine the period of processing of personal data:
- for the purpose of complying with our legal obligations, personal data will be processed for the duration of the relevant legal obligation of UWB;
- for the purpose of protecting the rights, legitimate interests and property of UWB, the personal data will be processed for the duration of the relevant legitimate interest of UWB. However, in the case of the initiation and duration of judicial, administrative or other proceedings in which the rights or obligations of UWB towards you will be addressed, the processing will not cease before the conclusion of such proceedings.
By the end of the calendar quarter following the end of the processing period at the latest, personal data for which the purpose of processing has ceased shall be irreversibly anonymised or securely destroyed. This does not apply to archival material which is permanently stored in accordance with the Act on Archives and Records Management and on Amendments to Certain Acts.
To whom is the personal data provided?
UWB may provide your personal data to public authorities to whom the UWB is obliged to provide your personal data pursuant to generally binding legal regulations. These recipients will process your personal data as separate controllers independent of UWB.
If this is necessary to protect the rights, legitimate interests and property of UWB, we may transfer your personal data to, for example, judicial or administrative authorities, bailiffs, etc.
UWB is also entitled to provide your personal data to persons who process personal data for UWB as its processors (e.g. accountants, tax or legal advisors, IT service providers). Upon your request, we will provide you with an up-to-date list of UWB processors who process your personal data. Please note that the list of the UWB processors may change and be updated over time.
We will only ever transfer your personal data to the extent necessary to protect your right to data protection and your privacy as much as possible.
Is personal data transferred abroad?
In general, we do not transfer your personal data outside the European Economic Area (EEA). If one of the recipients of your personal data processes personal data in a country outside the EEA, it may be transferred to such third country. However, in such a case, we will ensure that your personal data is processed in compliance with the relevant safeguards (e.g. by entering into standard contractual clauses with the recipient of the personal data).
Please note that in accordance with Act No. 106/1999 Coll., on Free Access to Information, as amended, we are obliged to publish certain information in a manner that allows remote access (e.g. by publishing it on our website). In this case, persons located outside the EEA may also have access to your information so published.
Updating your personal data
We will make reasonable efforts to ensure the accuracy of your personal data. To help us do this, please only provide us with accurate, truthful and up-to-date information. If you become aware that information processed by UWB is inaccurate, untrue or out of date (e.g. due to a change in your personal data), please inform us so that we can take corrective action.
